Terms of Service | Next Gen Photography

SCHEDULING:
Please contact us via email or phone no less than 24 hours before your preferred shoot time. We will try to accommodate all requests, but we cannot guarantee next-day shoots. If the photographer arrives at the shoot and cannot gain access to the property, the full agreed-upon amount will be billed. The shoot will take about an hour although some larger property shoots may take longer.

WEATHER:
We will make every effort to schedule shoots on good weather days (Sunny and dry). However, if the weather is questionable and we complete the shoot on the scheduled day and time and are requested to return on another day to “redo” exterior photos, there will be an additional charge. It is up to the client to decide if they want to reschedule to do weather conditions.

THE SHOOT:
The homeowner or someone authorized by the homeowner (the agent) should be present at the shoot to give access to the home and to discuss any special considerations such as what should be included or excluded in shots. Our goal at the shoot is to provide a minimum of 20 quality photos that include a front exterior, back exterior, and all the major rooms such as living room, dining room, family room, kitchen, master bedroom, master bath, and bedrooms. Powder rooms, small bathrooms, utility rooms or garages are not a shooting priority unless you give us direction otherwise. If we are requested to return to the location to add any “missed” shots, there will be a minimum $50.00 charge. It is important that someone is there to give guidance to the photographer.

PETS:
Please make sure pets are contained during the shoot. Pets should never be included in photos and need to be out of the way during the shoot.

CANCELLATION POLICY:
If cancellation or rescheduling is necessary, please give us 24 hours' notice. If the shoot is canceled with less than 24 hours notice, the full amount will be billed and payable upon receipt.

PHOTO DELIVERY:
Once the photos are shot they will be edited and optimized for quality and we will make every effort to have the photos delivered to you via email within 48 hours, but we cannot guarantee delivery in that time frame. You will receive an e-mail with a link and instructions on downloading your photos. Videos take just as long to edit so if you get a photo/video package expect it to take longer than 48 hours.

PHOTO RIGHTS AND USAGE:
All photos produced for the client may be used by that agent for all marketing associated with the current sale of the property in accordance with local MLS rules. Please note that the photos will be copyrighted by the photographer and a license granted only to the agent and NOT to any third party.
Any usage of the photos by a third party, including but not limited to architects, builders, stagers, designers, sellers or buyers is prohibited unless approved in writing by the photographer.

PAYMENT:
Payment is due upon receipt of your photos unless contracted otherwise. For ease of our clients, you can pay the photographer at the time of the photoshoot. Cash, Check, or Venmo is acceptable. Checks should be made payable to "Next Gen Photography".
